Yesterday, on September 14th 2004, the „Economic Police“ did close the bexx air head office. Therefore, bexx air is unable to continue its operation.
No bookings or payments can be accepted and no flights can be operated with immediate effect.
The “Economic Police” accuses bexx air of operating without a travel agency license.
As everyone knows, bexx air has never operated as a travel agency and did not intend to do so. As there is no word about charter flights in the Bulgarian law, a court would have to decide on the license required. At no stage, bexx air had the opportunity to clarify this as no one in the administration was interested in the law.
The office has been shut down without a court decision or court case. Internationally, premises can only be shut down when crime is committed- crime such as drug dealing, the production of false money or weapon dealing.
For bexx air, which has recently been approved in its application to become a member of the European Low Fare Airlines Association, this action of the administration is absolutely illegal and against all European laws.
This action has obviously been taken to protect the Bulgarian market in order to maybe find investors for Bulgaria Air and maybe to protect the interests of the local coach companies.
The way the action has been taken forces the idea someone has been paid to act this way and this one has misused his legal power.
bexx air herewith offers a reward of up to 1.000 Euro for information leading to the people who paid and the ones who have taken any bribe.
The way bexx air has been shut down is also a signal to all foreign investors that Europe is still far away from Bulgaria and that business and investment is not protected in Bulgaria.
All people working at bexx air are sad about how all their efforts and energy has been wasted in order to protect third party interests and lost their believe in the Bulgarian administration. The entire bexx air team did do everything to change the market and make traveling between Eastern- and Western Europe easier and affordable.
Everyone who has been traveling with bexx air got to know the spirit and enthusiasm with which all employees did work.
Passengers are stranded this weekend. Some of them, being abroad have no money to return, others are with visas which will get invalid. It is the duty of the Government who has put the power to the administration to shut down bexx air to take care of its people.
bexx air would have the money to fly. bexx air is not bankrupt. But bexx air is not able to perform this operation due to the administrations action.
bexx air urges the Government:
1) to advise the administration to issue the licenses required in their opinion in order to continue operating.
2) to take care of the stranded passengers by chartering an airplane to transport its people
3) to protect the rights of investors, our employees and our passengers by putting the administration in its place
In the event, the Government will bring home its stranded people, bexx air is willing to share the costs of this operation.
If no action is taken by the government and bexx air remains shut down, bexx air will refund the money to all passengers after accounting and by going in liquidation. The amount to be refunded will be based on a quote which is to be calculated.
Anyhow, bexx air will go to court and sue the administration for the losses of the investors of bexx air and its passengers for its illegal action in order to refund the passengers and the investors all money.
The government should look up the story of Freddy Laker to be aware what we are talking about!
bexx air invites all passengers to join us in this court case.
TUI, Lufthansa and other foreign companies operate flights to Bulgaria, sell here but the money goes abroad.
bexx air is a Bulgarian company, which uses solely Bulgarian products and labor. bexx air has paid all social taxes, all taxes and fulfilled its obligations. How can one shut down such a successful company ? How does this country want to be prepared for Europe and its competition in aviation business ?
bexx air would like to thank all passengers for their support and its airline partner HemusAir and its management for the outstanding good collaboration.
Everyone working for bexx air will remain in Bulgaria, we will sue the Government and will do everything to return the money to our people. And we will continue to change the aviation market in Bulgaria.

Da kann ich mir ja meine Reiseerfahrung sparen. Fakt ist, die in in der Webseite verbreiteten "News" sind ja schön http://www.bexx-air.com aber ein Anruf beim wirklichen Carrier Hemus Air gibt schnelle Aufklärung: "Der letzte Flug ist nicht bezahlt, darum fliegen wir nicht!" Kommentar überflüssig.
Aber : Wer ist denn eigentlich Dirk Wiesemann - any input?? Da wollen doch einige Ihr Geld bekommen....

dear partners and friends,
I am writing these lines in an internet café in the heart of Sofia as the administration did close our headquarter and we are cut off from any connection to our passengers and partners.
Today, we would like to keep you updated about the developments and we would like to inform you about your rights and what is happening with your money and your booked flights.
During the past days, we have had meetings with lawyers, business partners and airlines here. And one thing is for sure: The action against bexx air and its cheap tickets was illegal by Bulgarian and European law. We will proof this in court and claim for losses above 5,2 Mio. Euro.
This is what our passengers can expect so far:
Passengers who did not travel on 17th and 20th September will find a claim form on our website within the next week. We will collect the claims of you (money back, extra costs for flights with other companies, a fine for inconvenience and all other costs incurred).
Passengers who want to travel in September and October: The money will be claimed in front of the court by us and refunded as soon as possible
Passengers traveling in November and December will be asked by us, whether we shall re-book them on scheduled flights for free
Passengers traveling on our special Christmas flights will be transferred to a tour operator who will operate these flights for us
On the 8th of November, we will start our operation and sales again- with ticket prices from € 8 per ticket and with even more new exciting destinations.
Please find on this webpage also a small press summary which will update you on the current developments.

Billig Fliegen ist "in". Seit wann ist jedoch billiger Umgang mit Kunden angesagt?
Uns ist folgende Geschichte passiert: Ich habe für mich und für meinen 10 Monate alten Sohn Flüge bei der Fluggesellschaft bexx air gekauft. Durch Zufall habe ich erfahren, dass die von mir gekaufte Flugstrecke von bexx air nicht mehr geflogen wird. Die Betonung liegt auf Zufall, von bexx air habe ich bis heute keine Nachricht über diese unwesentliche Änderung erhalten. Nach einer telefonischen Anfrage wurde ich informiert, dass wir mit einem Bus zu einem 180 km entfernten Flughafen transportiert werden. Die freundliche Mitarbeiterin am Telefon konnte meine Unzufriedenheit nicht verstehen und empfand sie als Rumzickerei. Auf Anschlussflüge wird keine Rücksicht genommen. Pech! Außerdem wurde mir mitgeteilt, dass ich meinen 10 Monate alten Sohn im Bus auf dem Schoss zu halten habe, Sicherheitskindersitze haben die Busse nicht. Davon rät die Polizei zwar dringend ab, aber ... genug Rumzickerei. Beim zweiten Anruf hatte ich nicht so viel Glück, die freundliche Mitarbeiterin von bexx air hat einfach den Hörer mitten im Gespräch aufgelegt.
In der auf der Internetseite von bexx air angegebenen Firmensitzadresse befindet sich die Firma nicht. Die Mitarbeiter am Telefon verweigern jeglichen persönlichen Kontakt und verweisen auf Beschwerdemanagement per E-mails, auf die sie nie antworten. Nicht mal ein Briefkasten von bexx air hängt an dieser Adresse. Wir brauchen einen neuen Ausdruck für Briefkastenfirma – E-mail-firma.
Bezugnehmend auf die Geschäftsbedingungen von bexx air, habe ich meine Forderung um Zurücküberweisung der Flugpreise an den Geschäftsführer Dirk Wiesemann per E-mail geschickt, worauf er mit einem Smile und einzig und allein dem Hinweis "Lassen Sie sich den Paragrafen am besten von einem Anwalt erklären" geantwortet hat. Keine Anrede, keine "freundliche Grüße", schließlich müssen Billig-Fluggesellschaften überall sparen.
Ich hoffe, Herr Wiesemann bekommt die Rechnung für dieses Verhalten.
So ganz blicke ich da auch nicht mehr durch. Zumindest hat Bexx ja die anfänglichen Spekulationen widerlegt, dass die niemals fliegen würden. Von daher mag auch die Ankündigung stimmen, dass es ab November weiter geht. Vielleicht ist es besser so. Low Cost um "jeden Preis" muss hier auch nicht sein!

Bulgaria closes offices of Bexx Air

SOFIA - The Bulgarian authorities have closed down the Sofia offices of Germany-based low cost airline Bexx Air for operating without the proper licence, the Transport Ministry said.
Bexx Air chief executive Dirk Wiesemann threatened to sue the Bulgarian authorities for 5.2 million euros.
"We have sent a number of letters to this company, warning it that it does not have a valid operations licence in Bulgaria and has never applied to get one. The German embassy has also been contacted", Bulgarian Transport Minister Nikolay Vassilev told Bulgarian NTV channel
He also voiced concerns that Bexx Air could be a so-called "pyramid" scheme.
In the beginning of the 1990s, Bulgaria saw a boom of illegitimate insurance, banking and tour operator companies, known as pyramids, which after operating for some time suddenly declared insolvency and ripped off thousands customers of their savings.
Since January 2004, Bexx Air Express has offered on the Internet regular low-cost charter flights to and from Germany even though it did not have a tour operator's licence.
The company does not have its own aircraft but leases Bulgarian air carriers' planes.
"We are not a travel agency and have never thought of becoming licenced as one," company officials were reported as saying in the Bulgarian weekly magazine Capital.
In a press release, Wiesemann declared that the closing of the company's offices "obviously aims at safeguarding the Bulgarian market, finding investors for (Bulgarian national carrier) Bulgaria Air and protecting the interests of local tour operators".
Capital magazine reported that the Bulgarian Transport Ministry had previously refused to liberalise the air transport market and let in major low cost airlines such as Irish budget airline Ryanair.

a refund form will be mailed to all passengers by Thursday 14th October. It is now in the final approval with our lawyers and advisors. You will be asked for your banking details for refunding money. Ein Schelm, wer Böses dabei denkt.Dear friends and passengers,
it is now exactly a month ago when the economic police did shut down the bexx air office, accusing us for illegal operation because we did not hold a travel agency license. Media reports about this act may be found below.
We are currently setting up a new office. We do not intend to fly for the time being because we would like to make shure, next time we start, everyone doing aviation and tourism business in Bulgaria agrees and the authorities are happy.
It seems only a matter of a few months as everyone realized, that it might be better to bulid up a Bulgarian low fare airline than to have the European competitors flying to Bulgaria. And we know, our know how is required for this kind of operation.
In the meantime, it is time to refund our passengers the money. It is easy to understand, that the investors of bexx air, which were willing to put further money in this venture did not agree to put money in a company which was shut down and could not sell anymore.
During the past weeks, I have been traveling thru Europe, meeting our investors, authorities of the EU, the airport partners and other airlines. Everyone is looking close on the developments with bexx air- but of course, no one wants to take a risk till things are settled.
I have come to Bulgaria to make shure, everything is settled proper. And we have done our homework. We have the opportunity to refund our passengers who bought a ticket and could not fly an immediate amount of 24,66% on the paid but not flown plus another 75,34% credit on future flights if bexx air will have the opportunity to start flying again.
This refund will be done equal to everyone. For legal reasons, each passenger will have to sign and fax a form. This form will be emailed to all customers as from today. This procedure will take till Tuesday as it has to be done individually. Upon receipt of the signed form by fax, the refund will be done by bank transfer within another 10 working days. Please have in mind, we still do not have an office and operate from internet cafes.
Me and my staff still remember our first regular flight on 19th of March 2004, we remember the "Fly First Time Your Life" promotion, whereby everyone could fly for free, the opening of our office, where we did paint the walls ourselves, the happy faces of our passengers when they were on board and also of course all the trouble- technical problems, the closure of our shop.... and so on. But at the end, we all have had a succesful time and did learn to love each other and our passengers. And this is why we all want to continue. At the right time, with the right partners but the same spirit.

tag aus einem Internetcafe in Sofia wo wir die refunds durchführen. Es wurde ja viel spekuliert. Von Geldwäsche und Falschgeld weil wir Münzen der Mazedonischen Nationalbank originalversiegelt nach NRN geflogen haben bishin wir würden die Flüge nicht bezahlen und ich wäre längst in Jamaica :-)

Aber habt Ihr schon einmal richtig Angst gehabt?
Um Eure Freunde oder Gesundheit?
Das war hier letzten Monat die Situation als wir uns mit der Regierung angelegt haben. Aber inzwischen hat sich alles etwas beruhigt, ich bin zurück in Sofia und wir arbeiten erst einmal am Refund, dann daran wie es weitergeht.
Schade um V-Bird. Der Flughafen und die enthusiastischen Mitarbeiter haben das nicht verdient.
Wollte nur mal Hallo sagen.
